• Dealership websites and inventory management
• Financing integrations and BHPH tools
• AI chatbots and IVR phone systems
• Document generation and e-signature services
• Customer relationship management
• Virtual showrooms and photo editing tools

Dealer Responsibilities

Dealers using VinVin.one remain solely responsible for:

• Compliance with all applicable laws and regulations
• Financing disclosures and lending practices
• Customer data handling and privacy compliance
• Transaction practices and vehicle sales agreements
• Accuracy of vehicle information and pricing
• All communications sent through the platform

Fintech Compliance

VinVin.one acts as a technology provider and:

• Does not provide lending services or make credit decisions
• Does not offer financial advice
• All financial services are performed by dealerships and their third-party lending partners
• Dealers are responsible for compliance with all lending regulations

Buy Here Pay Here Liability

For Buy Here Pay Here (BHPH) operations:

• All BHPH terms, collections, and customer agreements are the responsibility of the dealership
• VinVin.one bears no liability for payment defaults
• VinVin.one is not responsible for regulatory compliance issues related to BHPH operations
• Dealers must ensure their BHPH practices comply with all applicable state and federal laws

AI Disclaimer

VinVin.one provides AI-powered features including chatbots, IVR assistants, and automated responses:

• AI-generated responses are informational only and may contain inaccuracies
• Dealers and users should independently verify all information provided by AI systems
• AI systems cannot make binding commitments on behalf of dealerships
• VinVin.one is not liable for decisions made based on AI-generated content

Electronic Signatures & E-Sign Consent

By using VinVin.one, you consent to conduct business electronically, including:

• Receiving documents, notices, and disclosures electronically
• Signing documents and agreements using electronic signatures
• Accepting terms and policies through electronic acceptance

Legal Validity

Electronic signatures and electronic records created through VinVin.one are legally valid and enforceable under:

• Federal: Electronic Signatures in Global and National Commerce Act (E-SIGN Act), 15 U.S.C. § 7001 et seq.
• State: Uniform Electronic Transactions Act (UETA) as adopted by the State of Missouri, RSMo § 432.200 et seq.

You agree that electronic signatures have the same legal effect as handwritten signatures, and electronic records satisfy any requirement for written documents.

Audit Records

System logs record timestamps, IP addresses, user identification, document hashes, and acceptance actions for audit and legal compliance purposes. These records may be used as evidence of electronic consent and agreement execution.

Withdrawal of Consent

You may withdraw your consent to conduct business electronically by contacting us, but this may limit your ability to use certain platform features.

Limitation of Liability

VinVin.one shall not be liable for:

• Indirect, incidental, or consequential damages
• Financial losses or regulatory penalties incurred by dealerships
• Dealership business decisions
• Actions of third-party service providers
• Data accuracy issues resulting from user input

Termination

Accounts may be suspended or terminated for violations of these terms or misuse of the platform. Upon termination, data may be deleted or returned upon request in accordance with our data retention policies.

Arbitration Clause

Any disputes arising from these Terms or use of the VinVin.one platform shall be resolved by binding arbitration in the State of Missouri. Users waive any right to participate in a class action lawsuit or class-wide arbitration.

Governing Law

These Terms are governed by the laws of the State of Missouri, without regard to conflict of law principles.

Changes to Terms

We reserve the right to modify these Terms at any time. Continued use of the platform after changes constitutes acceptance of the updated Terms. Material changes will be communicated to registered users.
